Terms & Conditions
Welcome to Emerging Computers Ltd. These Terms & Conditions govern your use of our website and the purchase of any products from our online store. By accessing our site and placing an order, you agree to be bound by these terms.
🛍️ Ordering & Contract Formation
- Order Acceptance: Your order is an offer to buy from us. A binding contract is only formed once we confirm your order and dispatch the item.
- Pricing Errors: We reserve the right to cancel orders if a product is listed with an incorrect price or description due to typographical or technical errors.
- Stock Availability: All items are subject to availability. If an item is out of stock after you order, we will contact you to offer an alternative or a full refund.
💰 Payments & Pricing
- Currency: All prices on our website are listed in Kenyan Shillings (KSh).
- Payment Methods: We accept secure payments via M-Pesa, Bank Transfer, and authorized checkout gateways.
- Cash Payments: Cash payments are also accepted for valid transactions (e.g., in-store purchases or cash on delivery where applicable).
- Full Payment: Orders will only be processed and dispatched once full payment has been received and verified.
🚚 Shipping & Delivery
- Delivery Fee: Free delivery applies exclusively to orders over KSh 20,000. Orders under KSh 20,000 incur a flat delivery fee of KSh 450.
- Timelines: Delivery schedules for Nairobi City and locations outside Nairobi are estimates and are handled by our third-party carriers, Wells Fargo and Lakeland.
- Risk of Loss: Risk of loss and title for the products pass to you upon our delivery of the items to the carrier.
🔄 Returns, Refunds, & Non-Returnable Items
- 14-Day Policy: Eligible returns must be initiated within 14 days of delivery. Items must be unused and in original, resellable packaging.
- Non-Returnable Consumables: Due to the nature of the products, Software licenses, Ink/Toners, and Paper products cannot be returned or refunded under any circumstances.
- Refund Processing: Approved refunds are processed back to your original payment method within 3 to 5 business days after our technical team inspects the item.
💻 Limitation of Liability
- Maximum Liability: Emerging Computers Ltd is not liable for any indirect, incidental, or consequential damages resulting from the use of our products or website.
- Website Downtime: We do not guarantee that our website will be uninterrupted or error-free at all times.
⚖️ Governing Law
- Kenyan Jurisdiction: These Terms & Conditions are governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes will be subject to the exclusive jurisdiction of the Kenyan courts.
